This Agreement sets the terms and conditions for your use of maxpressy.com’s products and services (in the further text may appear as “MaxPressy”). Users and customers must accept the terms and conditions of this agreement and that way confirm that have read, understood, and agree to the Terms of Service described here.
This agreement may be updated from time to time without notice. You can review the most current version of the Terms of Service at any time on this page.
We create and sell WordPress plugins. By purchasing a plugin you obtain support for that product for a certain period of time. Though in essence a product, since it includes support, in the further text this may be referenced as a “Service” as well, along with other services we provide or intend to provide.
Purchasing plugins does not include installation or customization services. Support includes:
- Availability to answer questions regarding the product
- Answering technical questions about the product’s features
You oblige to pay the price agreed for the services we provide, either stated on our site or arranged verbally. We reserve the right to change our prices at any time. This will be documented with a written notice. Notice of any price alteration will be sent via email to the email address that we hold for your account with us or it will be publicly available on our site. If you have already purchased a certain service then the price modification will only become effective when the service reaches the end of its current term.
By placing an order you become a Customer and that way you may get access to the account and the library of items that you purchased. Contrary, if your service includes just a downloadable product, it may be emailed to you without account creation. You need to be 18 years or over to become a Customer. If you’re under 18 you will need to use the account of a parent or legal guardian who is at least 18 years of age, with their permission, and this adult will be responsible for all your activities.
You promise that the information you give us is true, accurate and complete and that you will keep your account information up-to-date (including a current email address). Your account is not transferable. You should take all reasonable steps to ensure that your login credentials and password remain private.
Licenses
Our plugins are licensed under the GNU General Public License v2 (GPLv2) or later. We also generate and provide license keys for each purchased product. Only customers that confirm the purchased license are obliged to gain support and updates for the plugin. By confirming the license key on your end, we may receive some data from you:
- Website URL
- Website IP address
Product licenses are accessible on a payment cycle basis:
- Yearly: You gain access to updates and support for one year.
- One time: You get the updates and support to the lifetime of the product.
Warranty
MaxPressy makes no express or implied warranties regarding the service or product functionality. We cannot guarantee they will function with all 3rd party components, plugins, and under all environments. No verbal advice or information provided by MaxPressy’s staff either through emails or other support channels creates a warranty or alters this document.
We cannot guarantee our plugins will work with older versions of WordPress. We’ll do our best to keep the products up-to-date and working with the latest version of WordPress. You are responsible to keep our plugin up-to-date for any security fixes or other functional availability.
We reserve the right to reject support requests for problems that occur after our product files have been modified.
You agree that in no event MaxPressy will have financial liability to you.
Delivery of Services
Upon successful payment, you will receive a receipt from our billing system. Please save and retain a copy of this in a safe place for future reference.
All orders are delivered electronically via email, If you have any questions about your order please contact us by opening a support ticket. You will also receive a license key via email.
Products and Services are available after the completion of payment which is delivered through the e-commerce solution PayHip. PayHip is an authorized payment processor for maxpressy.com. By accepting the Terms agreement with MaxPressy you also acknowledge and accept the policy of PayHip.
Grounds for suspension and termination
If for any reason we find your behavior or content received from you inappropriate we reserve the right, with or without notice, to suspend or terminate the service provided for you immediately.
Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled right away to suspend the provision of Services to you. You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business. If you fail to pay any sums due to us as they become due, we may suspend the Services and/or terminate this Agreement right away without notice to you.
If you are a company and you go into insolvent liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors, we shall be entitled to terminate this Agreement right away.
Refund Policy
By purchasing our products, you’re allowed 30 days after the order to request a refund. After 30 days of the order, under no circumstances the refund will be issued.
Amendments
These Terms may be amended in any respect at any time by MaxPressy. Your continued use of the Service will be deemed consent to any such amended Terms and Policies. If you do not wish to continue to use the Service as a result of any such amended Terms and Policies, you may provide notice of your wish to terminate your use of MaxPressy’s Service or Account.
Governing law and jurisdiction
As we’re located in Serbia, this agreement and its subject matter shall be governed in accordance with Serbian law and its harmonization of legislation with EU law.
